Comment Period Open for Nebraska’s Cross-State Air Pollution Rule State Implementation Plan

A public notice is now available on the NDEQ website for the proposed State Implementation Plan (SIP) addressing the allocation of emissions under the Environmental Protection Agency’s (EPA) Cross-State Air Pollution Rule (CSAPR). The SIP will replace the Federal Implementation Plan (FIP) for the allocation of 2016 emission allowances to power plants under CSAPR. CSAPR limits the emissions of sulfur dioxide and nitrogen oxides from electric generators with a nameplate capacity of 25 MWe and producing power for sale. The intent of the rule is to limit the effects of fine particulate matter and ozone pollution from Nebraska traveling downwind to neighboring states and affecting their ability to attain or maintain the National Ambient Air Quality Standards (NAAQS). The proposed SIP will divide Nebraska’s 2016 allotment of sulfur dioxide and nitrogen oxide allowances among power plants in Nebraska based upon EPA’s CSAPR modeling and budgets.

The NDEQ is accepting comments on the proposed SIP until March 23, 2015 and a public hearing is scheduled for March 25, 2015. Please note that the public hearing will only be held if requested. Any questions or comments can be sent to ndeq.airquality@nebraska.gov.
