Startup, Shutdown, & Malfunction (SSM) Emissions at Industrial Facilities

On May 22, 2015, EPA issued a final rule to ensure states have plans in place that require industrial facilities across the country to follow air pollution rules during times when the facility is starting up or shutting down, or when a malfunction occurs (or "SSM").

On EPA's list of states with SIP provisions for which the EPA either grants or denies the petition, the final action on Nebraska's petition was 'Deny'. In denying the Petition for Nebraska, the EPA found that the particular provisions identified by the Petitioner were not substantially inadequate to meet the requirements pursuant to CAA section 110(k)(5), and thus the EPA did not issue a SIP call for the state.
