Letter of Non-Compliance
Starting Sept. 1, NDEE will use a Letter of Non-Compliance (LNC) to communicate when a facility is in violation of environmental regulations. In the past, the agency used different forms of correspondence (such as Letters of Warning, Notices of Violation, Repairs or Corrective Action Letters, and Compliance Requests) depending on the severity of the violation.
By using the LNC as its single tool, NDEE hopes to bring consistency, fairness, and transparency to the Return to Compliance (RTC) process.
An LNC will tell facilities about any violations that were found, a description of what is needed for the facility to return to compliance, and a schedule for the facility to follow. This letter allows NDEE to streamline its process so its team members can focus on helping facilities return to compliance and protecting Nebraska’s environment.
