Site Summary:

Two underground storage tanks were removed at this site in February of 1996. At the bottom of the 10 foot excavation, free product was noted floating on the groundwater. The site was backlogged until January 2000 when NDEQ activated the site and requested a three well Tier 1 be performed at the site. The Tier 1 indicated all monitoring wells that were installed passed the Tier 1 criteria, and the site was closed. In early 2001 as part of a QA/QC verification, NDEQ reactivated the site for a Geoprobe survey. The survey indicated free product at the site. A Tier 2 investigation was performed, and two monitor wells confirmed the presence of free product at the site. All other monitor wells with dissolved contamination fall below SSTLs. This contract is for free product cleanup only.

The geology at the site is sandy clay down to the aquifer where it changes to all sand. All of the property falls on Union Pacific right of way or Department of Roads right of way.

Site Specifications:

1. Overexcavation is approved for this site by the lessee and property owner.

2. This property is owned by the railroad and leased by Mr. Ted Cook. He does not need to be notified before the potential PFP contractors visit the site. However, he will need two weeks notification before the actual cleanup begins.

3. The railroad remediation right-of-way permitting process on behalf of the future PFP contractor is completed.

4. The PFP Contractor will need to provide a satisfactory certificate of insurance to the railroad before field work begins and submit the one page form that goes with it. The railroad has agreed to continue, and extend to the PFP contractor at no additional charge, their supplemental umbrella policy that DEQ paid for during the investigation phase at this site.

5. The railroad will need to see a detailed set of plans for the proposed remediation before construction begins. They informed DEQ during discussions with them, that one type of remediation they will not approve is oxygenate injection, specifically, Hydrogen Peroxide. They have informed DEQ that overexcavation, pump and treat, and AS/SVE systems, or other common techniques, should present no problems for approval. If the PFP Contractor submitted a bid based on a remediation plan that was not approved by the railroad, the PFP Contractor will have the option of modifying the plan to fit the railroad's requirements with no change in price to the contract. Otherwise the contract will not be signed and will be readvertised for bid with the new railroad requirements included. If the potential PFP contractor has never been through the railroad's "checklist" of required items to be performed before, during and after the contract, please visit their website. NDEQ also has a copy of this checklist. The railroad we are dealing with at this site is Union Pacific, and you can expect a 60 to 90 day delay to have the work plan approved by the railroad.

6. While we believe that the above stated railroad matters have all been agreed to with this agency, sometimes policies change. DEQ's intent is not to penalize the contractor for any changes made by the railroad that result in paperwork delays before the remediation begins.
