This is to notify all vendors who responded to the above-referenced Request For Proposal that the State of Nebraska intends to award the contract for conducting a study to examine the status of State of Nebraska solid waste management programs being administered by the Department of Environmental Quality in order to make recommendations to modernize, revise, and perhaps merge such programs, regarding litter and waste reduction to:

The State of Nebraska, Department of Environmental Quality (NDEQ), is issuing this Request for Proposal, RFP Number # 5513Z1 for the purpose of selecting a qualified Contractor to conduct a Solid Waste Management Programs Study.

Written questions are due no later than February 1 2017, and should be submitted via e-mail to Stephanie.vap-morrow@nebraska.gov.

Bidder should submit one (1) original of the entire proposal. Proposals must be submitted by the proposal due date and time of February 28, 2017 at 2:00 p.m. Central Time.

PROPOSALS MUST MEET THE REQUIREMENTS OUTLINED IN THIS REQUEST FOR PROPOSAL TO BE CONSIDERED VALID. PROPOSALS WILL BE REJECTED IF NOT IN COMPLIANCE WITH THESE REQUIREMENTS.
  1. Sealed proposals must be received in NDEQ Lincoln Office by the date and time of proposal opening indicated above. No late proposals will be accepted. No electronic, e-mail, fax, voice, or telephone proposals will be accepted.
  2. This form “REQUEST FOR PROPOSAL FOR CONTRACTUAL SERVICES” MUST be manually signed, in ink, and returned by the proposal opening date and time along with bidder’s proposal and any other requirements as specified in the Request for Proposal in order to be considered for an award.
  3. It is the responsibility of the bidder to check the website for all information relevant to this solicitation to include addenda and/or amendments issued prior to the opening date. Website address is as follows: http://deq.ne.gov and http://das.nebraska.gov/materiel/purchasing.html

IMPORTANT NOTICE: Pursuant to Neb. Rev. Stat. § 84-602.02, all State contracts in effect as of January 1, 2014, and all contracts entered into thereafter, will be posted to a public website. Beginning July 1, 2014, all contracts will be posted to a public website managed by the Department of Administrative Services.

In addition, all responses to Requests for Proposals will be posted to the Department of Administrative Services public website. The public posting will include figures, illustrations, photographs, charts, or other supplementary material. Proprietary information identified and marked according to state law is exempt from posting. To exempt proprietary information you must submit a written showing that the release of the information would give an advantage to named business competitor(s) and show that the named business competitor(s) will gain a demonstrated advantage by disclosure of information. The mere assertion that information is proprietary is not sufficient. (Attorney General Opinion No. 92068, April 27, 1992) The agency will then determine if the interests served by nondisclosure outweigh any public purpose served by disclosure. Cost proposals will not be considered proprietary.

To facilitate such public postings, the State of Nebraska reserves a royalty-free, nonexclusive, and irrevocable right to copy, reproduce, publish, post to a website, or otherwise use any contract or response to this RFP for any purpose, and to authorize others to use the documents. Any individual or entity awarded a contract, or who submits a response to this RFP, specifically waives any copyright or other protection the contract or response to the RFP may have; and, acknowledge that they have the ability and authority to enter into such waiver. This reservation and waiver is a prerequisite for submitting a response to this RFP and award of the contract. Failure to agree to the reservation and waiver of protection will result in the response to the RFP being non-conforming and rejected.

Any entity awarded a contract or submitting a RFP agrees not to sue, file a claim, or make a demand of any kind, and will indemnify, hold, and save harmless the State and its employees, volunteers, agents, and its elected and appointed officials from and against any and all claims, liens, demands, damages, liability, actions, causes of action, losses, judgments, costs, and expenses of every nature, including investigation costs and expenses, settlement costs, and attorney fees and expenses (“the claims”), sustained or asserted against the State, arising out of, resulting from, or attributable to the posting of contracts, RFPs and related documents.

Solid Waste Management Programs Study Questions and Answers

1. Is there a specified budget amount or “not to exceed” amount?

NDEQ is looking for the best proposal at the best price to award a fixed-price contract.

2. We were wondering when the evaluation criteria for the NDEQ’s Solid Waste Management Programs Study would be released (RFP # 5513Z1).

It is attached at the end of the questions and answers.

3. What is the estimated budget for this project?

NDEQ is looking for the best proposal at the best price to award a fixed-price contract.

4. Under IV. Project Description and Scope of Work, B1a.i says that the Contractor will “Review all associated State statutes and regulations related to this scope of work”. Will NDEQ provide a list of all documents to review?

Yes, it will be provided at the time of contracting.

5. Under IV. Project Description and Scope of Work, B1b says the Contract will be “Performing a needs assessment of the recycling and composting programs in the state, including the need for infrastructure development, operating standards, market development, coordinated public education resulting in behavioral change, and incentives to increase recycling and composting”. Can you clarify the tasks, including the anticipated data review?

It is up to the bidder to evaluate the tasks and data review to complete this scope of work element. The language in the scope of work was derived from LB 1101.

6. Will NDEQ provide a single point of contact throughout the course of the project (that will be available as a resource to benefit data gathering regarding statutes, regulations, NDEQ operating structure, grant programs and other project information) as requested from the Contractor?

Yes, a single point of contact will be provided.

7. It appears it is the NDEQ’s responsibility to take the Contractor’s findings and recommendations and use these as a basis to guide and develop new regulations, requirements and programs. Is the Contractor expected to draft any specific or new language related to NDEQ legislation, regulations, requirement and grants as part of the project deliverables?

No.

8. What is the evaluation criteria weighting and when will it be posted to the internet?

It is attached at the end of the questions and answers.

9. II. M. 2. (Page 5) – Section indicates the inclusion of Certificate of Good Standing or Letter of Good Standing is a mandatory requirement of Proposals however II. O. indicates this document is to be provided within 90 days of notification of intent to award and prior to execution of contract; please clarify what is required for proposal.

It is a Mandatory Requirement that must be provided with the bid proposal.

10. Is the Monthly Report to be prepared based on a format prescribed by the Department or can the format as selected by the consultant?

It can be selected by the contractor.

11. Will all of the information to be provided by NDEQ be in an electronic form or will it be in printed form and if it is in printed form is it to be available in Lincoln or will it be sent to the consultant?

It is anticipated that all information will be provided in an electronic format. However, there may be some hard copy documents which NDEQ will evaluate how best to provide those documents.

12. Based on the committee meeting I attended in Kearney it appears the committee members have diverse ideas relating to the priorities of the study. Are the priority issues presented in the RFP in the order of priority?

For the purposes of bidding on this RFP, the project issues in the scope of work are the issues the department determined to be important for this study.
