The Nebraska Department of Environment and Energy (Department) is issuing notice to provide an opportunity for any interested person to submit written comments, objections, and/or hearing requests concerning the reissuance of a National Pollutant Discharge Elimination System (NPDES) Permit to the following concentrated animal feeding operation.
The Public Comment Period will run from July 25th, 2024 through August 24th, 2024.

The Department proposes to reissue an NPDES Permit for the operation located in the S 1/2, SW 1/4 & W 1/2, SE 1/4, Section 17 and NW 1/4, Section 27 and NW 1/4, SW 1/4, Section 35 and S 1/2, SE 1/4, Section 07, Township 27N, Range 05E and W 1/2, SE 1/4, Section 34, Township 28N, Range 04E, Dixon County, Nebraska to prevent discharges. The operation’s livestock waste control facilities (LWCFs) include sixty (60) buildings with doghouses, four (4) aboveground tanks, fifty-two (52) underground tanks, and one (1) manure dryer. The operation has a maximum animal capacity of 4,788,400 laying hens and 2,079,000 pullets in confinement. The permit reissuance would be for a period of up to five (5) years and would restrict pollutant discharges to comply with the requirements of Department regulations. The application for renewal includes a detailed nutrient management plan from which permit terms have been identified. (See Fact Sheet).

All comments received during the public comment period will be considered in the final decision for reissuance of the NPDES Individual Permit. A request for a public hearing must be submitted in writing and must state the nature of the issues proposed to be raised at a hearing. A determination to hold a hearing will be based on factual environmental or regulatory considerations. National Pollutant Discharge Elimination System (NPDES) Individual Permit


A draft NPDES Permit has been prepared for the animal feeding operation (AFO) listed below. The Nebraska Department of Environment and Energy (Department) has determined that this AFO is a concentrated animal feeding operation (CAFO) and is required to obtain an NPDES Permit for operation of its livestock waste control facility and land application practices.

Discharge Limits
The doghouse pits and storage tanks must be designed, constructed, operated and maintained to prevent a discharge during the storage period and to provide 180 days of storage prior to the winter months.
Permit Terms of the Nutrient Management Plan (NMP)
1) The Permittee must ensure adequate storage of manure, litter, and process wastewater, including procedures to ensure proper operation and maintenance of the storage facilities by complying with Sections 1 & 2 of the NMP.

2) The Permittee must ensure proper management of mortalities as described in Section 3 of the NMP.

3) The Permittee must ensure that clean water is diverted, as described in Sections 1 & 2 of the NMP.

4) The Permittee must prevent direct contact of animals with waters of the state as described in Title 130.

5) The Permittee must ensure that chemicals and other contaminants are handled on-site as described in Section 3 of the NMP.

6) Appropriate site-specific conservation practices are to be implemented, including as appropriate, buffers or equivalent practices to control runoff of pollutants to waters of the State.

7) The Permittee must maintain the specific records required in Part II, Section E, Table A of the draft permit.

8) The Permittee must implement the protocols of the NMP to land apply manure, litter, or process wastewater to ensure appropriate agricultural utilization of the nutrients in the manure, litter, or process wastewater.

9) The Permittee must follow the protocols for appropriate testing of manure, litter, process wastewater, and soil as found in the NMP.

Land Application Practices
All waste is transferred.
