for Beatrice Area Solid Waste Agency Municipal Solid Waste Landfill
under consideration by the
Nebraska Department of Environmental Quality

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environmental Quality (NDEQ) has received an application to modify the permit of Beatrice Area Solid Waste Agency Municipal Solid Waste Landfill, 400 Ella Street, Beatrice, NE. After review of the permit application, a preliminary determination has been made to recommend modification of the permit.

FACILITY DESCRIPTION. The permit allows the operation of an existing municipal solid waste landfill under Nebraska's solid waste management laws and regulations. The landfill shall receive household waste, alone or in combination with other types of wastes such as commercial solid waste, industrial waste, nonhazardous sludge, or conditionally exempt small quantity generator waste, and which is not a land application unit, surface impoundment, injection well, or waste.

MODIFICATION. The Beatrice Area Solid Waste Agency (BASWA) has submitted a major permit modification to include an expansion (Phase 5) of the BASWA Landfill. This 5.6 acre Subtitle-D landfill expansion allows for an additional 450,000 cubic yards of waste disposal capacity and an anticipated increase in the life of the site of approximately 8.5 years. The expansion is located in between and overlays the closed Old Beatrice Landfill and Phase 1 of the BASWA Landfill. This major modification will also include a new leachate collection system.

FACILITY LOCATION. The property is located at 3426 W Locust Road, Beatrice, NE. The legal description of Beatrice Area Solid Waste Municipal Solid Waste Landfill is E ½ SE ¼ Section 17 Township 3 North Range 6 East of the 6th Principal Meridian Gage County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. When a permit is modified, only the conditions subject to modification are reopened. All other aspects of the existing permit shall remain in effect for the duration of the unmodified permit.

The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed modification. Public comments and hearing requests shall be made to: David Haldeman, Waste Division Administrator, Nebraska Department of Environmental Quality, 1200 'N' Street, Suite 400, The Atrium, P.O. Box 98922, Lincoln, NE 68509-8922.

The NDEQ will make a final decision to modify the permit based on the permit application, the compliance status of Beatrice Area Solid Waste Agency Municipal Solid Waste Landfill, and public comment received.
