CONSTRUCTION AND OPERATING PERMIT

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This Public Notice period will be from July 19, 2017 through August 21, 2017. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2438).

The proposed livestock waste control facility (LWCF) is located in the W 1/2, Section 08 & E 1/2, Section 07, Township 26N, Range 08W, Antelope County, Nebraska. The application proposes the following major modifications: an increase of animal head count, modifications of existing holding pond and existing debris basin, and constructions of two holding ponds, one parlor, four debris basins, one solid separator, one sand lane, and four freestall buildings.

The application indicates an existing maximum of 600 head of dairy cows and 990 head of dairy heifers, and proposes an increase of 1,400 head of dairy cows and 2,010 head of dairy heifers, for a total maximum capacity of 2,000 head of dairy cows and 3,000 head of dairy heifers.

The existing LWCF includes one holding pond, one debris basin, and one freestall building.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130–Livestock Waste Control Regulations. Currently, the Department intends to issue a Construction and Operating Permit for the proposed LWCF. Upon completing a review of any written comments received, NDEQ will make a final decision on the permit application and respond to any comments.
