PUBLIC NOTICE

Notice is given to the public, according to Chapter 14 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Nebraska Department of Environment and Energy (NDEE) is proposing to issue a construction permit to Green Plains York LLC (FID 59094). Green Plains York LLC is a fuel-grade ethanol manufacturing plant (Standard Industrial Classification code 2869) located at 1414 Road O in York, York County, Nebraska.

The NDEE reopened construction permit CP15-034 (issued July 11, 2016) for cause in accordance with Title 129, Chapter 15, Section 006, and notified Green Plains York LLC on August 12, 2019. The permit was reopened for the inclusion of state T-BACT NSPS Kb requirements for ethanol production storage tank operations and monitoring that was inadvertently omitted in the previous permitting action.

During this permitting action the NDEE also became aware that some equipment identified in previous permits at Green Plains York LLC had been removed. That equipment change was incorporated into this permitting action. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) will be: -44.61 tpy of Particulate Matter (PM); -22.40 tpy of PM ≤ 10 microns (PM10); -27.19 tpy PM ≤ 2.5 microns (PM2.5); -0.87 tpy Sulfur Dioxide; -40.80 tpy Oxides of Nitrogen; -38.87 tpy Carbon Monoxide; -79.36 tpy Volatile Organic Compounds; and 0.00 tpy total HAPs.



York County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The proposed permit and supporting materials are available Saturday, November 2, 2019 through Monday, December 2, 2019 at the NDEE, Suite 400, 1200 "N" Street, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
