for CITY OF BROKEN BOW CONSTRUCTION & DEMOLITION DISPOSAL AREA
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to renew the permit of City of Broken Bow Construction & Demolition Disposal Area, P.O. Box 567, Broken Bow, NE 68822. After review of the permit application, a preliminary determination has been made to recommend renewal of the permit. The term of the permit shall be five years.

FACILITY DESCRIPTION. The permit allows the operation of an existing construction & demolition disposal area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.

FACILITY LOCATION. The property is located approximately 4 miles southwest of Broken Bow on Highway 21 South. The legal description of City of Broken Bow Construction & Demolition Disposal Area is N ½ Section 24 Township 16 North Range 21 West of the 6th Principal Meridian Custer County Nebraska.

MAJOR MODIFICATION. This permit renewal includes a major modification to modify the bottom elevation of the disposal area. The bottom elevation will be excavated in the southern and eastern limits of the disposal area.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. Public comments and hearing requests shall be made to: Daniel LeMaistre, Waste Permit Section Supervisor, Nebraska Department of Environment & Energy, P.O. Box 98922, Lincoln, NE 68509-8922.
The NDEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of City of Broken Bow Construction & Demolition Disposal Area, and public comment received. NDEE will notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by April 2, 2023.
