NOTICE OF INTENT TO RENEW AND MODIFY PERMIT #NE0203149
for VALENTINE AREA SOLID WASTE AGENCY MUNICIPAL SOLID WASTE LANDFILL
under consideration by the
Nebraska Department of Environmental Quality

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environmental Quality (NDEQ) has received an application to renew and modify the permit of Valentine Area Solid Waste Agency Municipal Solid Waste Landfill, P.O. Box 177, Valentine, NE. After review of the permit application, a preliminary determination has been made to recommend renewal and modification of the permit. The term of the permit shall be July 16, 2019 through July 15, 2024.

FACILITY DESCRIPTION. The permit allows the operation of an existing municipal solid waste landfill under Nebraska's solid waste management laws and regulations. The landfill shall receive household waste, alone or in combination with other types of wastes such as commercial solid waste, industrial waste, nonhazardous sludge, or conditionally exempt small quantity generator waste, and which is not a land application unit, surface impoundment, injection well, or waste pit.

FACILITY LOCATION. The property is located at 39856 US Highway 20 approximately 5 miles south of Valentine on Highway 20 on the east side of the road. The legal description of Valentine Area Solid Waste Agency Municipal Solid Waste Landfill is SE ¼ Section 16 Township 33 North Range 27 West of the 6th Principal Meridian Cherry County, Nebraska.

MAJOR MODIFICATION. A lateral expansion to add Phases 5-7 including an additional area east of Phase 4. Phases 1-7 will now have an air volume capacity of 567,492 cubic yards. The original capacity was 397,500 cubic yards for Phases 1-4. Phase 4 will increase approximately 1,000 square feet to the east. Phases 5-7 will add approximately 175,000 square feet to the landfill floor footprint. The lateral expansion will bring the total landfill area to 12.5 acres.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The NDEQ will make a final decision to approve or deny the permit action based on the permit application, the compliance status of Valentine Area Solid Waste Agency Municipal Solid Waste Agency, and public comment received. NDEQ will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by April 27, 2019.
