NOTICE OF INTENT TO RENEW AND MODIFY PERMIT #NE0054739
for OPPD NORTH OMAHA FOSSIL FUEL COMBUSTION ASH LANDFILL
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to renew and modify the permit for Omaha Public Power District (OPPD), 444 South 16th Street Mall, Omaha, NE . After review of the permit application, a preliminary determination has been made to recommend renewal and modification of the permit. The term of the permit shall be May 16, 2020 through May 15, 2025.

FACILITY DESCRIPTION. The permit allows the operation of an existing fossil fuel combustion ash disposal area under Nebraska's solid waste management laws and regulations. The fossil fuel combustion ash disposal area shall dispose of fossil fuel combustion ash which by definition shall mean flyash, bottom ash, slag, and flue gas emission control ash generated from utility plants or other facilities in which coal is the primary fuel source.

MAJOR MODIFICATION. The modification of the permit includes: CCR Fugitive Dust Control Plan; Run-On/Run-Off Control System Plan; Groundwater Sampling and Analysis Plan; Closure Plan; and Post-Closure Plan.

FACILITY LOCATION. The property is located at 7475 John J Pershing Drive, Omaha, NE. The legal description of OPPD North Omaha Fossil Fuel Combustion Ash Landfill is the NW ¼ SW ¼ Section 27 Township 16 North Range 13 East of the 6th Principal Meridian Douglas County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal and modification. Public comments and hearing requests shall be made to: David Haldeman, Land Management Division Administrator, Nebraska Department of Environment & Energy, P.O. Box 98922, Lincoln, NE 68509-8922.

The NDEE will make a final decision to renew or deny the permit action based on the permit application, the compliance status of OPPD North Omaha Fossil Fuel Combustion Ash Landfill, and public comment received. NDEE will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by March 15, 2020.
