APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This Public Comment period will be from December 20, 2017 through January 22, 20187. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The proposed animal feeding operation livestock waste control facility (LWCF) is located in the NW 1/4, SW 1/4, Section 33, Township 12N, Range 20W, Dawson County, Nebraska. The application proposes the following major modifications: an increase in animal head count.

The application indicates an existing maximum of 5,990 head of swine greater than or equal to 55 lbs. or and 2,600 head of swine less than 55 lbs., and proposes a change in stocking practices to confine a maximum capacity of 6,250 head of swine greater than or equal to 55 lbs. or 18,000 head of swine less than 55 lbsan increase of 260 head of swine greater than or equal to 55 lbs. or 15,400 head of swine less than 55 lbs., for a total maximum capacity of 6,250 head of swine greater than or equal to 55 lbs. or 18,000 head of swine less than 55 lbs.

The existing livestock waste control facilities (LWCFs) LWCF includes one synthetically- lined anaerobic lagoon and one building with underfloor shallow pits with pull plugs. No new construction is proposed at this time.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued permit. Upon completion of review of any written comments received, NDEQ will make a final decision on the permit application and respond to any comments.
