NOTICE OF INTENT TO CERTIFY
DEPARTMENT OF ENVIRONMENTAL QUALITY
WATER QUALITY DIVISION
LINCOLN, NEBRASKA

In accordance with Section 401 of the Federal Clean Water Act (33 U.S.C. Par. 1251 et seq.), certification that Title 117 – Nebraska Surface Water Quality Standards (Nebraska Administrative Code) will not be violated has been applied for to the Nebraska Department of Environmental Quality (NDEQ) by the persons listed below for discharges requiring Federal permits or licenses.

Prairie Queen, LLC (4880 South 131st Street, Omaha) has applied for a § 404 permit under Nationwide Permit 29, Residential Development from the U.S. Army Corps of Engineers (USACE) to conduct activities in Waters of the United States. The proposed project (NWO-2016-02402-WEH) requires an individual state Water Quality Certification.

The proposed project (at 13101 Cornhusker Road, Papillion) is to prepare the site for residential development including a roadway, utiities and stormwater management.

In order to evaluate the impacts of this project on the water resources of the State, the Department of Environmental Quality encourages interested citizens to submit written comments related to the scope of state Water Quality Certification under Section 401 of the Federal Clean Water Act. Persons may comment upon or request a public hearing by writing Marty Link, NDEQ, P.O. Box 98922, Lincoln, NE 68509-8922, within 30 days after this publication date. Persons may request information about the application from the 401 Certification Coordinator, at the same address. A request for hearing must state the nature of the issues to be raised and all arguments and actual grounds supporting such position. Such comments shall be considered prior to making a final decision regarding the application. Copies of all materials are available for inspection and copying at NDEQ offices, the Atrium, 4th Floor, 1200 N Street, Lincoln, NE between 8:00 a.m. and 5:00 p.m., weekdays.
