NOTICE OF INTENT TO APPROVE AN


APPLICATION FOR A MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environment and Energy (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This public comment period will be from January 26, 2022 through February 25, 2022. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The operation’s existing livestock waste control facilities (LWCFs) are located in the NW 1/4, Section 19, Township 24N, Range 02W, Madison County, Nebraska. The existing LWCF includes one earthen holding pond, two synthetic-lined holding ponds, one settling basin, one catch cell, five freestall barns, one calf barn, one gravity screen solid separator, one pump station, one sand separator lane, one sand stacking pad, one mechanical solid separator, one manure stacking pad, two diversions, one feed storage basin, and three clean water diversions. The application proposes to construct one milking center (parlor and holding barn), one special needs/backpack barn, one freestall barn, one two-section freestall barn, and one clean water diversion, and the modification of one clean water diversion.

The application indicates an existing maximum of 1,840 head of dairy cattle and 500 head of dairy calves, and proposes a new maximum of 2,750 head of dairy cattle and 500 head of dairy calves, or 3,750 head of feeder cattle.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued Construction and Operating Permit. Upon completion of review of any written comments received, the Department will make a final decision on the permit application and respond to any comments.
