PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to permit the Smart Soil Compost Facility, 1082 S 190th Road, Shelton, Nebraska 68876. After review of the permit application and all supporting documents, a preliminary determination has been made to recommend issuance of the permit. The term of the initial permit shall be five years.

FACILITY DESCRIPTION. The permit allows the operation of a new composting facility under Nebraska's solid waste management laws and regulations. Composting is the controlled aerobic, thermophilic, microbial degradation of solid organic material such as raw or treated sewage sludge, animal manure, paunch manure, dead animals, plant or food residue or their mixtures, to a stabilized, humus like material.

FACILITY LOCATION. The property is located from Shelton, Nebraska, 1 mile east and approximately 8 miles north on 190th road. The legal description of Smart Soil Compost Facility is approximately 45 acres located in the E½, of the SE¼, Section 19, Township 11 North, Range 12 West of the 6th Principal Meridian, Hall County Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The NDEE will make a final decision to issue or deny the permit based on the permit application, the compliance status of Smart Soil Compost Facility, and public comment received. NDEE will notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by September 4, 2022.

Select “Search” and all the documents for that facility will appear. Use the “Index of Correspondence” to select the documents related to this public notice.
