NOTICE OF INTENT TO MODIFY PERMIT #NE0204188


for the Village of Arnold Construction & Demolition Waste Disposal Area
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to modify the permit for the Village of Arnold Construction and Demolition Waste Disposal Area, P.O. Box 70, Arnold, NE. After review of the permit application, a preliminary determination has been made to recommend modification of the permit. The term of the current permit shall remain unchanged from July 16, 2020 through July 15, 2025.

FACILITY DESCRIPTION. The permit allows the operation of an existing Construction and Demolition Waste Disposal Area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including but not limited to, fill materials, wood, land clearing debris, other yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles, and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.

MAJOR MODIFICATION. The major modification includes a lateral expansion of existing Cells 1 and 2, and the addition of a new Cell 3 to the south of the existing landfill area. The modification increases the waste disposal area by 2.21 acres, modifies final cover contours, and increases the life of the waste disposal area.

FACILITY LOCATION. The property is located approximately 2 miles north of Arnold on Dunning Road. The legal description of the Village of Arnold Construction and Demolition Waste Disposal Area is E ½ NE ¼ NE ¼ Section 16 Township 17 North Range 25 West of the 6th Principal Meridian Custer County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit modification. The NDEE will make a final decision to modify the permit based on the permit application, the compliance status of Village of Arnold Construction & Demolition Waste Disposal Area, and public comment received. NDEE will notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by August 21, 2022.
