NOTICE OF INTENT TO RENEW AND MODIFY PERMIT #NE0203254
for NPPD Gerald Gentleman Fossil Fuel Combustion Ash Landfill
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to renew and modify the permit of NPPD Gerald Gentleman Fossil Fuel Combustion Ash Landfill, 1414 15th Street, Columbus, NE to operate the NPPD Gerald Gentleman Fossil Fuel Ash Landfill in Sutherland, NE. After review of the permit application, a preliminary determination has been made to recommend renewal and modification of the permit. The term of the permit shall be December 16, 2019 through December 15, 2024.

FACILITY DESCRIPTION. The permit allows the operation of an existing fossil fuel combustion ash disposal area under Nebraska's solid waste management laws and regulations. The fossil fuel combustion ash disposal area shall dispose of fossil fuel combustion ash which by definition shall mean flyash, bottom ash, slag, and flue gas emission control ash generated from utility plants or other facilities in which coal is the primary fuel source.

FACILITY MODIFICATION. The modification is an addition of a leachate collection system for future cells (phases 3 through 7); the addition of a permanent leachate evaporation pond in the location of the temporary contact water pond from previous design and the removal of phase 8 and corresponding airspace from the deposition plan; modification of the final cover design; and everything needed to bring the facility into compliance with the CCR (coal combustion residuals)r rule which became effective October 14, 2015

FACILITY LOCATION. The property is located at 6089 S Highway 25, Sutherland, NE. which is 5 miles South of Sutherland on Highway 25. The legal description of NPPD Gerald Gentleman Fossil Fuel Combustion Ash Landfill is NW ¼ NE ½ Section 30 Township 13 North Range 33 West Lincoln County Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The NDEE will make a final decision to renew or deny the permit action based on the permit application, the compliance status of NPPD Gerald Gentleman Fossil Fuel Combustion Ash Landfill, and public comment received. NDEE will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by September 22, 2019.
