PROPOSED RESOURCE CONSERVATION AND RECOVERY ACT (RCRA)
POST-CLOSURE PERMIT RENEWAL FOR
DOUGLAS COUNTY CLOSED STATE STREET LANDFILL

The Nebraska Department of Environmental Quality (NDEQ) is providing notice of intent to renew a Resource Conservation and Recovery Act (RCRA) Post-Closure Permit for the closed Douglas County State Street Landfill. Douglas County owns and operates the State Street Landfill located at 12608 State Street, Omaha, Nebraska 68142.

From November 1980 until January 1983, the State Street Landfill accepted hazardous waste and co-mingled it with municipal solid waste. The types of Hazardous Waste that were accepted included the following: ignitable, toxic, corrosive, halogenated solvents, and sludges. The total volume of hazardous wastes received was approximately 248,596.65 cubic feet. Manifested waste had been received from Union Pacific Railroad, Western Electric, and Griffin Pipe Products. The hazardous waste management unit was closed in 1985 and certified closed in 1990. The municipal solid waste landfill ceased accepting waste on August 31, 1989.

There are numerous groundwater monitoring wells have been in place and used to detect and monitor the migration of contaminants. These groundwater monitoring wells will be monitored according to frequencies specified in the permit term. An active landfill gas collection system is in operation and will be used to remedy the landfill gas at the facility.

Resource Conservation and Recovery Act (RCRA)
Post-Closure Permit

Introduction:

The Nebraska Department of Environmental Quality (NDEQ) is planning to renew a Resource Conservation and Recovery Act (RCRA) Post-Closure Permit for the Douglas County State Street Landfill. Hazardous waste management operations have ceased at the site. Douglas County is responsible under RCRA for the continued monitoring and remediation of the facility, located at 12608 State Street, Omaha, NE 68142. This fact sheet describes the draft permit that NDEQ is proposing for Douglas County State Street Landfill.

The NDEQ received final authorization from EPA to implement its own hazardous waste management program and the 1984 Federal Hazardous and Solid Waste Amendments for Corrective Action in 1984 and 2016, respectively. The existing Permit has Part I that consists of Post-Closure requirements that was issued by the Nebraska Department of Environmental Quality. The Part II was issued by the U.S. Environmental Protection Agency regarding the corrective action activities for solid waste management units and areas of concern under the Hazardous and Solid Waste Amendments of 1984 (HSWA). In accordance with Title 40 Code of Federal Regulations § 270.51(d), EPA’s HSWA Part II Permit will remain in effect until the effective date of a new RCRA Post-Closure Permit issued by the Nebraska Department of Environmental Quality (NDEQ). On the date that the new draft RCRA Post-Closure Permit is renewed and issued by NDEQ, EPA's HSWA Part II Permit will no longer be in force. This single draft RCRA Post-Closure Permit will replace the existing Permit that consists of two Parts that was issued on May 1, 2006.

Background:

Douglas County owns and operates a closed municipal solid waste landfill in northwest Omaha. The solid waste landfill operated from July 1973 to August 1989. However, hazardous waste was disposed of with municipal waste from November 1980 until January 1983. NDEQ has based the issuance of the RCRA Post-Closure Permit on an evaluation of the facility’s activities. The State Street Landfill accepted 248,596.65 cubic feet of hazardous wastes resulting from various manufacturing processes. The hazardous waste site was closed in 1985 and certified as closed in 1990. This permit will require Douglas County to conduct groundwater monitoring and corrective action in order to ensure that there are no further threats to human health and the environment due to the release of contamination from the facility to the onsite soils and groundwater and offsite migration of the contamination plume. Community Involvement and Permitting Process:

State and federal hazardous waste regulations require that the public be given at least forty-five (45) days to review the administrative record for the draft permit prior to the regulatory agencies taking a final action.

The purpose of having a public comment period is to ensure that interested parties have the opportunity to evaluate the conditions specified in the draft permit and to provide their input into the permit decision-making process. The permit public comment period is scheduled to begin on October 25, 2017 and end on December 9, 2017.

At this time, the NDEQ does not plan to schedule a public meeting or an information session. However, if anyone wishes to request a public hearing, the written request must be submitted including a justification for the public hearing by December 9, 2017.

The NDEQ will make a decision based on the procedures for requesting a hearing and the justification provided. If a hearing is warranted, another 30-day public notice period will be provided prior to the hearing date.

Anyone wishing to comment on the draft RCRA Post-Closure Permit renewal may submit oral or written statements during the public hearing or submit written statements postmarked no later than December 9, 2017 to Mr. Bill Gidley (NDEQ) at the addresses listed below.

Making a Final Permit Decision

NDEQ will review all comments received during the public hearing, if any, and the public comment period before making a final permit decision. When the final decision to issue or to deny the permit is made, notice will be given to the facility, all persons who submitted written comments, all persons who commented at the public hearing, and all persons who requested notice of the final permit decision. The permit will become effective immediately upon its issuance if none of the public comments result in changes from the draft permit. The permit will become effective 30 days after notice of the final decision if public comments result in changes or at a later date specified by the NDEQ. Those who fail to file comments may petition for administrative review only to the extent that changes occur from the draft to the final permit.
