CONSTRUCTION AND OPERATING PERMIT

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This Public Notice period will be from June 22, 2017 through July 24, 2017. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2438).

The proposed livestock waste control facility (LWCF) is located in the NW Qtr, SW Qtr, Section 9, Township 21 N, Range 02 W, Madison County, Nebraska. The application as submitted is for the following scenarios: 1) a maximum of 9,600 head of swine under 55 lbs., 2) a maximum of 4,800 head of swine over 55 lbs, or 3) a maximum of 4,800 head of swine under 55 lbs. and 2,400 head of swine over 55 lbs.

The proposed LWCF includes two buildings with underfloor deep pits.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130–Livestock Waste Control Regulations. Currently, the Department intends to issue a Construction and Operating Permit for the proposed LWCF. Upon completing a review of any written comments received, NDEQ will make a final decision on the permit application and respond to any comments.
