Notice is given to the public, according to Chapter 14 of Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a Class I operating permit the Public Power Generation Agency (PPGA) for Whelan Energy Center Unit 2 (Facility 58048) for an electrical generation power plant (Standard Industrial Classification code 4911 Electric Services) located at 4520 East South Street, Hastings, Adams County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 267.69 tpy of Particulate Matter (PM), 241.51 tpy of PM ≤ 10 microns (PM10), 106.87 tpy PM ≤ 2.5 microns (PM2.5), 1,162.19 tpy Sulfur Dioxide, 779.37 tpy Oxides of Nitrogen, 1,453.29 tpy Carbon Monoxide, 39.19 tpy Volatile Organic Compounds, 8.01 tpy of Hydrochloric Acid (largest quantity individual Hazardous Air Pollutant (HAP), 20.76 tpy total HAPs, and 2,109,021.06 tpy Greenhouse Gases CO2 equivalents (CO2e).

Adams County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Adams County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The Department has reopened operating permit OP11S1-018 for cause in accordance with Title 129, Chapter 15, Section 006. The reason for reopening is that the permit did not contain the correct averaging period requirement for CO emissions testing, lacked directions for calculation of the 3-hour averaging, requirements for CO CEMS certification and monitoring, recordkeeping, and reporting.

The proposed permit and supporting materials are available for inspection by the public June 24, 2020 through July 27, 2020 at the office of the NDEQ, Suite 400, 1200 "N" Street, Lincoln, Nebraska, and electronically at Only those provisions that are being revised by this permit action are open for comment at this time. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.

Within 60 days after the US Environmental Protection Agency Administrator review, persons may petition the Administrator to object to the issuance of the proposed permit. Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the 30-day comment period, unless the petitioner demonstrates that it was not practicable to raise such objection within such period.
