Notice is given to the public, according to Chapter 14 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a construction permit to Waste Management of Nebraska, Inc. (FID# 62593) for the construction of a leachate evaporator system and removal of an existing source wide CO limitation at a municipal solid waste landfill (Standard Industrial Classification code 4953) located at 13505 N 216th St, Bennington, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed Construction and removal of existing source-wide limitation at this facility will be: 28.17 tpy of Particulate Matter (PM); 28.17 tpy of PM ≤ 10 microns (PM10); 6.73 tpy of PM ≤ 2.5 microns (PM2.5); 10.49 tpy of Sulfur Dioxide (SOx); 5.10 tpy of Oxides of Nitrogen (NOx); 154.45 tpy of Carbon Monoxide (CO); 20.59 tpy of Non-Methane Organic Compounds/Volatile Organic Compounds (VOCs); 0.53 tpy of Hydrochloric Acid (HCl); 0.66 tpy of Toluene; 2.49 tpy Individual Hazardous Air Pollutant (permit limit), 4.00 tpy Total Hazardous Air Pollutant (permit limit), and 25,935.30 tons CO2e/yr Greenhouse Gases.

Douglas County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Douglas County meets the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which specifies emission limitations for the leachate evaporator system, requires testing of emissions and leachate concentrations for several pollutants, specifies federal requirements, and specifies recordkeeping and reporting requirements; and specifies the removal of the source-wide CO limitation.

The proposed permit and supporting materials are available Friday, December 21, 2018 through Monday, January 21, 2019 at the NDEQ, Suite 400, 1200 "N" Street, Lincoln, Nebraska, and electronically at http://deq.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
