for Solid Waste Agency of Northwest Nebraska (SWANN) Solid Waste Transfer Station
under consideration by the
Nebraska Department of Environmental Quality

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environmental Quality (NDEQ) has received an application to modify the permit of Solid Waste Agency of Northwest Nebraska Solid Waste Transfer Station, P.O. Box 590, Chadron, NE. After review of the permit application, a preliminary determination has been made to recommend modification of the permit.

FACILITY DESCRIPTION. The permit allows the operation of an existing solid waste transfer station under Nebraska's solid waste management laws and regulations. The transfer station permit allows for the movement of solid wastes that are generated off of the premises of the facility to another solid waste management facility.

MODIFICATION. The facility is proposing to increase the size of the concrete storage pad from 700 square feet to 1,600 square feet which will allow storage for up to 256 bales of waste for a period of up to 6 days. This will allow ample time for storage in the event of inclement weather preventing transportation of the bales to the SWANN municipal solid waste landfill.

FACILITY LOCATION. The transfer station is located at 1010 E. Niobrara Avenue, Chadron, NE. The legal description of SWANN Solid Waste Transfer Station is the SW ¼ NW ¼ Section 16 Township 33 North Range 48 West of the 6th Principal Meridian Dawes County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. When a permit is modified, only the conditions subject to modification are reopened. All other aspects of the existing permit shall remain in effect for the duration of the unmodified permit.

The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed modification. The NDEQ will make a final decision to approve or deny the modification based on the permit application, the compliance status of SWANN Solid Waste Transfer Station, and public comment received. NDEQ will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by June 30, 2017.

INTRODUCTION

This Fact Sheet provides background information regarding a proposed modification to the SWANN Solid Waste Transfer Station located in Chadron, Nebraska. In accordance with Title 132, Chapter 2, 010.01D, SWANN has submitted, to the Nebraska Department of Environmental Quality (NDEQ), a request to modify their solid waste management permit. The proposed action modifies SWANN’s current permit that expires on March 15, 2020 and does not extend the term of this permit. The proposed modification does not meet the requirements of a minor modification of Title 132, Chapter 2, 010.04 and is subject to public participation procedures in Title 132, Chapter 2, 011. The transfer station is located in Section 16, Township 33 North, Range 48 West, Dawes County, Nebraska. Attachment 1 shows a site plan of the facility with the “Concrete Pad for Temporary Bale Storage” indicated.

DESCRIPTION OF PROPOSED MODIFICATION




The facility operates a Transfer Station in Chadron that bales solid waste for transportation and disposal at the SWANN Municipal Solid Waste Landfill (MSWL). On April 26, 2017, the facility submitted a letter to the NDEQ requesting a modification to their Solid Waste Transfer Station. The modification proposes the expansion of the outside concrete storage pad for an increase in the storage capacity of baled waste. The facility currently has a capacity to store up to 116 waste bales on the existing outside concrete storage pad prior to loading and transport to the SWANN landfill. The facility occasionally experiences inclement weather, or extended rain events, which have made roads into the disposal area of the SWANN landfill impassable for up to 3-5 days and have made the current storage capacity of the concrete storage pad inadequate to accommodate the storage of the waste bales. As a result, the facility has proposed a modification to expand the current concrete bale storage pad from approximately 700 ft2 to 1,600 ft2. The proposed expanded concrete storage pad would be able to accommodate the storage of 256 bales of waste through a period of up to 6 days, a timeframe sufficient to allow re-entry into the disposal area at the SWANN landfill. Liquids, from storm water coming into contact with the waste bales, will continue to be collected through drains on the expanded concrete storage pad and directed to the existing on-site storage tank for disposal at the local wastewater treatment plant. With the modification, bales of waste will be stored for no more than 7-days, at which time the SWANN landfill should become accessible. In the event that the SWANN landfill remains inaccessible and odors or vectors become a problem during the period waste bales are stored, it may become necessary for the facility to haul waste bales to another permitted municipal solid waste landfill. PUBLIC PARTICIPATION



As required by Title 132 – Integrated Solid Waste Management Regulations, Chapter 2, 011, the public must be given at least a thirty (30) day comment period for a modification not exempted as a minor modification. (see chapter 2, 010.04 for minor modification definitions) The comment period for this proposed modification begins on May 31, 2017 and will end on June 30, 2017. The Administrative Record includes all documents related to the requested permit modification.
