NOTICE OF INTENT TO RENEW PERMIT #NE0223572
for Northeast Nebraska Solid Waste Coalition Municipal Solid Waste Landfill
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to renew the permit of Northeast Nebraska Solid Waste Coalition Municipal Solid Waste Landfill, 610 Monroe Street, Norfolk, NE. After review of the permit application, a preliminary determination has been made to recommend renewal of the permit. The permit dates will be April 17, 2020 through April 16, 2025.

FACILITY DESCRIPTION. The permit allows the operation of an existing municipal solid waste landfill under Nebraska's solid waste management laws and regulations. The landfill shall receive household waste, alone or in combination with other types of wastes such as commercial solid waste, industrial waste, nonhazardous sludge, or conditionally exempt small quantity generator waste, and which is not a land application unit, surface impoundment, injection well, or waste pit.

FACILITY LOCATION. The property is located at 57220 825 Road which is approximately 1 mile east on Highway 91 from Clarkson, and 5 miles north on Highway 15. The legal description of Northeast Nebraska Solid Waste Coalition Municipal Solid Waste landfill is the NW ¼ Section 21 Township 21 North Range 3 East of the 6th Principal Meridian Stanton County Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. Public comments and hearing requests shall be made to: David Haldeman, Land Division Administrator, Nebraska Department of Environment & Energy, P.O. Box 98922, Lincoln, NE 68509-8922.

The NDEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of Northeast Nebraska Solid Waste Coalition Municipal Solid Waste Landfill, and public comment received. NDEE will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by February 29, 2020.

Copies of the draft permit, legal notice and administrative record are available at the Stanton Public Library, Stanton, NE; and at the Lincoln headquarters of the NDEQ, 1111 Lincoln Mall, Suite 100, Lincoln, NE between 8:00 a.m. and 5:00 p.m. on weekdays.
