PROPOSED REMEDIAL ACTION DECISION
Tiny Houses

Notice is hereby given pursuant to Neb. Rev. Stat. § 81-15, 185.01, that the Nebraska Department of Environment and Energy (NDEE) is proposing intent to approve final cleanup levels and remedial action at Tiny Houses, 1528 North 16th St., Omaha, Nebraska. This proposed determination is in accordance with Neb. Rev. Stat. § 81-15, 185. Tiny Houses is located in the Southeast ¼ of the NW ¼ of Section 15, Township 15 North, Range 13 East, Douglas County, Nebraska.

The groundwater at this site has been contaminated as a result of previous operations. The primary contaminants of concern (COCs) are arsenic and lead. The NDEE has assigned the groundwater pollution event at this site a Remedial Action Class three (RAC-3). RAC numbers are used to prioritize the groundwater pollution events with one (1) being the highest priority and three (3) being the lowest priority.

The NDEE is proposing the following remedial actions:

Remove and dispose of soils impacted with lead and arsenic from the affected area that are above the respective remediation goals or naturally occurring background levels in order prevent direct contact of impacted soil by on-site persons. The proposed final cleanup levels can be found in the Fact Sheet.
Evaluate the vapor intrusion pathway and, if complete, control the pathway via sampling and excavation.

Any person may receive additional information, submit written comments regarding the proposed actions, or request a public hearing, in writing, on or before February 23, 2022. A request for hearing must state the nature of the issues to be raised and all arguments and factual grounds supporting such position. If the Director grants a public hearing, the hearing will be advertised by public notice at least 30 days prior to its occurrence. Comments and requests should be mailed to:
