NOTICE OF INTENT TO APPROVE AN
APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This Public Comment period will be from June 6, 2018 through July 6, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The existing and proposed livestock waste control facilities (LWCFs) are located in the SE 1/4, Section 14, Township 25N, Range 08W, Antelope County, Nebraska. The application proposes the following major modifications: an increase in animal head count, modification of one storage pit (to include an expansion and conversion from a synthetic liner to an earthen liner), one gutter/flush freestall barn, one clean water diversion and an expansion of one special needs barn and one gutter/flush freestall barn.

The application indicates an existing maximum of 1,850 head of mature dairy cows and proposes a new one-time maximum capacity of 2,500 head of mature dairy cows.

The existing LWCFs include one earthen storage pit, one synthetic-lined storage pit, five freestall barns, one special needs barn, one sick barn, two milking parlors and holding barn/pens, two reception pits, one sand barn, one sand settling lane, one sand stacking pad, one solid separator building, one solid stacking pad, four clean water diversions, two lift stations and two wet wells.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued Construction and Operating Permit. Upon completion of review of any written comments received, the Department will make a final decision on the permit application and respond to any comments.
