PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environmental Quality (NDEQ) has received an application to renew and modify the permit of KGP Services, LLC Construction & Demolition Waste Disposal Area, 1806 Square Turn Blvd., Norfolk, NE. After review of the permit application, a preliminary determination has been made to recommend renewal and modification of the permit. The term of the permit shall be December 5, 2018 through December 4, 2023.

FACILITY DESCRIPTION. The permit allows the operation of an existing construction and demolition waste disposal area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.

MODIFICATION. The modification is to allow for vertical expansion of the facility over the previous Phases I, IV, and the western portion of Phase III. The proposed vertical expansion varies in height depending on location, to the far south and east the expansion will be 0 feet and at the northwest corner the maximum height expansion will be approximately 37 feet from the previously permitted Phase IV. The expansion would increase the facility capacity to total of approximately 520,000 cubic yards of material and provide approximately 4 years and 10 months of additional storage capacity.

FACILITY LOCATION. The property is located at 55251 Kaneb Road, Hadar, NE. The legal description of KGP Services, LLC Construction & Demolition Waste Disposal Area is SE ¼ SW ¼ Section 31 Township 25 North Range 1 West of the 6th Principal Meridian Pierce County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal and modification. The NDEQ will make a final decision to renew or deny the permit based on the permit application, the compliance status of KGP Services, LLC construction and demolition waste disposal area, and public comment received. NDEQ will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by September 30, 2018.
