Notice is given to the public, according to Chapter 14 of Title 129 - Nebraska Air Quality Regulations, regarding the application of Gavilon Grain, LLC (FID# 96410) for permission to revise its permit for a country grain elevator (Standard Industrial Classification code 5153) located at 70424 Highway 61, Benkelman, Nebraska. The anticipated change in emissions of regulated air contaminants, including fugitive emissions, in tons per year (tpy) due to the proposed permit revision is estimated to be 58.70 tpy of particulate matter (PM), 13.76 tpy of PM ≤ 10 microns (PM10), 0.14 tpy of PM ≤ 2.5 microns (PM2.5), -0.96 tpy of sulfur dioxide (SO2), -24.91 tpy of oxides of nitrogen (NOx), -14.37 tpy of carbon monoxide (CO), -1.91 tpy of volatile organic compounds (VOC), and -0.32 tpy of hazardous air pollutants (HAPs).

Dundy County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129 - Nebraska Air Quality Regulations, which: permits the construction of two metal cylindrical grain storage bins; permits the construction of a new grain receiving pit; increases the source-wide grain receiving limit; revises requirements for the application of mineral oil; places a throughput limitation on grain drying; updates the permit to as-built specifications for equipment; revises recordkeeping and reporting requirements; and incorporates several “No Permit Required” projects.

The proposed permit and supporting materials are available Wednesday, August 23, 2017 through Friday, September 22, 2017 at the NDEQ, Suite 400, 1200 "N" Street, Lincoln, Nebraska, and electronically at http://deq.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
