CONSTRUCITON AND OPERATING PERMIT

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This Public Comment period will be from January 10, 2018 through February 12, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The proposed livestock waste control facilities (LWCFs) are located in the S 1/2, S 1/2, SE 1/4, SW 1/4, Section 35, Township 12N and Parts of the W 1/2, Section 02, Township 11N, Range 12W, Hall County, Nebraska. The application proposes a maximum of 4,299 head of feeder cattle.

The existing Livestock Waste Control Facilities (LWCFs) include three holding ponds and four debris basins. The application proposes to modify the three existing holding ponds and to construct one new holding pond and one new debris basin.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application and issue a Construction and Operating Permit for the proposed LWCF. Upon completion of review of any written comments received, NDEQ will make a final decision on the permit application and respond to any comments.
