NOTICE OF INTENT TO APPROVE AN APPLICATION FOR A


CONSTRUCTION AND OPERATING PERMIT

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following animal feeding operation.

This Public Comment period will be from April 25, 2018 through May 28, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2438).

The proposed livestock waste control facilities (LWCF) are located in the NE 1/4, Section 11, Township 11N, Range 20W and NE 1/4, Section 35, Township 12N, Range 20W, Dawson County, Nebraska. The existing facility permit allows for a maximum 21,960 head of Swine (≥ 55 pounds) and 7,680 head of Weaned Pigs (<55 pounds). The current application would allow for a maximum of either 26,250 head of Swine (≥ 55 pounds), or up to 7,500 head of Swine (≥ 55 pounds) and 54,000 head of Weaned Pigs (<55 pounds).

The current permit describes 2 earthen storage pits, 1 earthen lagoon (2-cell), 1 synthetic-lined lagoon, 2 buildings with underfloor deep pits, 10 buildings with underfloor shallow pits with pull plugs, and a building with a gutter flush. Since that permit was issued in 2013, 1 earthen storage pit, 1 building with an underfloor deep pit, 1 building with an underfloor shallow pit and the 1 gutter flush building have been closed by the operation. A Department inspection verified proper closure of these facilities. The current application proposes the following: construction of 1 building with an underfloor deep pit, 1 new lift station to the synthetic-lined lagoon and the closure of 2 buildings with underfloor shallow pits.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130–Livestock Waste Control Regulations. Currently, the Department intends to issue a Construction and Operating Permit for the proposed LWCF. Upon completing a review of any written comments received, the Department will make a final decision on the permit application and respond to any comments.
