NOTICE OF INTENT TO ISSUE A
CONSTRUCTION AND OPERATING PERMIT

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.
This Public Notice period will be from November 3, 2017 through December 5, 2017. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2438).

The proposed livestock waste control facility (LWCF) is located in the S 1/2, SW 1/4, Section 19, Township 12N, Range 10W, Hall County, Nebraska. The application as submitted is for an existing maximum of 2,500 head of feeder cattle and for a proposed expansion of 500 head of feeder cattle, to total a maximum capacity of 3,000 feeder cattle.
The existing LWCF includes two debris basins. The application as proposed will convert the two debris basins into two wet basins, install two lift station, and construct one holding pond.
The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130–Livestock Waste Control Regulations. Currently, the Department intends to issue a Construction and Operating Permit for the proposed LWCF. Upon completing a review of any written comments received, NDEQ will make a final decision on the permit application and respond to any comments.
