NOTICE OF INTENT TO APPROVE AN APPLICATION FOR A


CONSTRUCTION AND OPERATING PERMIT

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following animal feeding operation.

This Public Comment period will be from June 13, 2018 through July 16, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2438).

The existing and proposed livestock waste control facilities (LWCF) are located in the NW 1/4, Section 06, Township 19N, Range 01W, Platte County, Nebraska. The existing facility operates with 2,000 head of Weaned Pigs (<55 pounds) as a non-permitted small animal feeding operation. The current application would allow for a maximum of 4,400 permitted head of Weaned Pigs (<55 pounds).

The existing LWCF includes 1 earthen storage pit and 2 buildings with underfloor shallow pits with pull plugs. The application proposes construction of 1 building with an underfloor shallow pit with pull plugs.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130–Livestock Waste Control Regulations. Currently, the Department intends to issue a Construction and Operating Permit for the proposed LWCF. Upon completing a review of any written comments received, the Department will make a final decision on the permit application and respond to any comments.
