Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following concentrated animal feeding operation.

This Public Comment period will be from June 6, 2018 through July 9, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The existing and proposed livestock waste control facilities (LWCFs) are located in the SE 1/4, NW 1/4 & Pt. S 1/2, Section 09, SE 1/4, Section 10 and E 1/2, NE 1/4, Section 15, Township 11N, Range 10W, Hall County, Nebraska. The existing LWCFs include seven holding ponds, three debris basins, five diversion ditches, one lift station and one truck wash. The application proposes the construction of one holding pond, three debris basins and one lift station, as well as the modification of two holding ponds, one debris basin (concrete sump) and three diversion ditches.

The application indicates an existing one-time maximum capacity of 20,000 head of feeder cattle. No head count change is proposed at this time.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for major modification. Upon completion of review of any written comments received, the Department will make a final decision on the permit application and respond to any comments.
