NOTICE OF INTENT TO TRANSFER OWNERSHIP AND MODIFY PERMIT #NE0204471
for Green Acres Recycling Construction & Demolition Waste Disposal Area
under consideration by the
Nebraska Department of Environmental Quality

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environmental Quality (NDEQ) has received a request to transfer ownership of Eco-Storage Investments, Inc. to Eco-Storage Investments, LLC and an application to modify the permit of Eco-Storage Investments, LLC dba Green Acres Recycling Construction & Demolition Waste Disposal Area, 3701 Dahlman Ave., Omaha, NE. After review of the permit application, a preliminary determination has been made to recommend transfer of ownership and major modification of the permit.

FACILITY DESCRIPTION. The permit allows the operation of an existing construction and demolition waste disposal area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.

MODIFICATION. The proposed major modification is a vertical expansion over the current open area of 1.8 acres. The expansion increases the total height of the disposal area approximately 25 feet and includes terraces on the final cap of the disposal area. It should be noted that the prior owner of the facility had filled waste above the permitted grades. The current permitted open area had approximately 5,278 cubic yards of remaining airspace at the time of purchase, excluding adjustments for the overfill, and the new parent company needs additional space. This major modification requests the overfilled waste be left in place and the proposed vertical expansion design be incorporated into the permit. The revised available airspace, as a result of the major modification is expected to be approximately one year, as it is anticipated that approximately 50,000 cubic yards of material will be received in the coming year.

FACILITY LOCATION. The property is located at 3701 Dahlman Ave., Omaha, NE. The legal description of Green Acres Recycling Construction & Demolition Waste Disposal Area is the NW ¼ SE ¼ Section 33 Township 15 North Range 13 East of the 6th Principal Meridian Douglas County Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. When a permit is modified, only the conditions subject to modification are reopened. All other aspects of the existing permit shall remain in effect for the duration of the unmodified permit.

The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed modification. The NDEQ will make a final decision to approve or deny the permit actions requested based on the permit application, the compliance status of Green Acres Recycling Construction & Demolition Waste Disposal Area, and public comment received. NDEQ will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by May 5, 2018.
