NOTICE OF INTENT TO APPROVE AN APPLICATION FOR


A CONSTRUCTION AND OPERATING PERMIT

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the proposed decision for the following animal feeding operation.

This Public Comment period will be from October 24, 2018 through November 26, 2018. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The existing and proposed livestock waste control facilities (LWCF) are located in the N 1/2, NE 1/4, Section 06, Township 20N, Range 04W, Platte County, Nebraska. The application describes one (1) existing non-certified underfloor deep pit building that currently confines up to 750 head of swine greater than or equal to fifty-five pounds. The application proposes the construction of two (2) additional underfloor deep pit buildings. Upon construction completion, the three buildings will confine a maximum capacity of 2,499 head of swine greater than or equal to fifty-five pounds (833 head in each building).

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve a Construction and Operating Permit for the proposed LWCF. Upon completion of review of any written comments received, NDEQ will make a final decision on the permit application and respond to any comments.
