PUBLIC NOTICE OF SURETY RELEASE

Pursuant to Title 135, Rules and Regulations for Mineral Exploration Holes, Chapter 7, the Nebraska Department of Environmental Quality is proposing to release Surety for Mineral Exploration in Merrick and Hamilton counties. Overland Sand and Gravel, 1576 L Road, Central City, NE 68826 has completed mineral exploration at several locations under Mineral Exploration Permit NE0210516. The sites are located in Merrick and Hamilton counties, Nebraska.

Overland Sand and Gravel has completed mineral exploration hole abandonment and site reclamation as outlined in the above referenced permit. A records review and inspections have been completed to confirm abandonment and reclamation activities.

Persons may request a fact sheet, may comment upon or object to the release of the surety, or may request a public hearing by writing to Marty Link, Nebraska Department of Environmental Quality, P.O. Box 98922, Lincoln, Nebraska 68509-8922, prior to January 30, 2018. A request for public hearing shall state the nature of the issues proposed to be raised at a hearing. All comments shall be considered prior to making a decision regarding a public hearing. If the Department of Environmental Quality receives substantive comments regarding this proposed surety release, a public hearing may be scheduled.

Copies of the fact sheet and all information pertaining to the surety release will be available for viewing and copying at the Department of Environmental Quality, Suite 400, 1200 N Street, The Atrium, in Lincoln between 8:00 a.m. and 5:00 p.m. weekdays, or mailed upon request. Fact Sheet

For proposed release of Surety (Surety Bond Number: 588623) held for Mineral Exploration Permit Number NE0210516. Mineral exploration conducted by Overland Sand and Gravel, under this permit has ceased in Merrick county and Hamilton county.

1. Overland Sand and Gravel obtained a Mineral Exploration permit (NE0210516) from the NDEQ on October 27, 2004, for 20 mineral exploration holes. Conditions of the permit included providing surety for reclamation activities in the event the company was to prove insolvent.

2. Overland Sand and Gravel provided surety in the form of a Surety Bond to the NDEQ in the amount of $1,000.00 on October 27, 2004. This surety could only be released after satisfactory restoration of the area explored had been completed.

3. On November 30, 2017, Overland Sand and Gravel submitted an email requesting that the process to release their bond be started. The email indicated that mineral exploration under the permit had been completed. A document review was conducted in order to confirm proper hole abandonment and surface reclamation procedures were followed.

4. On the basis of preliminary staff review, the NDEQ has made a tentative determination to release the Surety Bond Number: 588623.

5. Amanda Jones from the NDEQ inspected exploratory boring abandonment and reclamation and released holes 1-21 on December 18, 2017.


6. The following is a brief explanation of the statutory and regulatory provisions on which the proposed surety release is based.

a. Mineral Exploration Permit Number NE0210516 and a Surety Bond for the amount of $1,000.00.
b. Nebraska Environmental Protection Act and related laws.
c. NDEQ Title 135 - Rules and Regulations for Mineral Exploration Holes.
d. Email from Brent Kunze (Overland Sand and Gravel), received November 30, 2017, requesting surety release.
e. Inspection Report Reclamation Form for Mineral Exploration Holes from Amanda Jones (NDEQ) dated December 18, 2017.

7. Written Comments
Copies of public information pertaining to this issue (Surety release) are available for review and copying at the Department’s office, Suite 400, The Atrium, 1200 N Street, Lincoln, Nebraska 68508 between 8:00 a.m. and 5:00 p.m., weekdays.

The public may comment upon or object to the proposed surety release, in writing, prior to January 30, 2018. All substantive comments and/or objections shall be considered prior to making the final decision regarding this surety release. Any interested person may request a public hearing, if no hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised at the hearing.
