for CITY OF LINCOLN CONSTRUCTION & DEMOLITION WASTE DISPOSAL AREA
under consideration by the
Nebraska Department of Environmental Quality
PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environmental Quality (NDEQ) has received an application to renew and modify the permit of the City of Lincoln Construction & Demolition (C&D) Waste Disposal Area, 5101 N 48th Street, Lincoln, NE. After review of the permit application, a preliminary determination has been made to recommend renewal and modification of the permit. The term of the permit shall be July 16, 2018 through July 15, 2023.
FACILITY DESCRIPTION. The permit allows the operation of an existing construction and demolition waste disposal area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals. Although the Title 132 definition of C&D waste includes the above materials, the City of Lincoln does not accept these materials for disposal within the C&D Waste Disposal Area: C&D waste containing large quantities of paper, gypsum board, rubber, plastics, and asphalt (e.g. asphaltic concrete cement paving); treated wood (e.g. railroad ties, utility poles); loads of C&D wastes containing more than 50 percent wood waste, however tree root balls are accepted.
FACILITY LOCATION. The property is located at 5101 N 48th Street, Lincoln, NE. The legal description of the City of Lincoln Construction & Demolition Waste Disposal Area is NE ¼ Section 5 Township 10 North Range 7 East and part of the SE ¼ Section 32 Township 11 North Range 7 East of the 6th Principal Meridian Lancaster County Nebraska.
MAJOR MODIFICATION. The facility is proposing a major expansion that includes a 65 acre lateral expansion and a vertical expansion within the permitted 240 acres. The vertical expansion will revise the final contours, including extending the side slopes along the western side of to an approximate elevation of 1160 feet above median sea level and adjusting the peak elevation in conjunction with the lateral expansion. The C&D waste disposal area will increase from 121 acres to 186 acres. The new landfill capacity will be 3,925,000 cubic yards, an increase of 1,665,100 cubic yards from the current permitted volume of 2,259,900 cubic yards.
OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The NDEQ will make a final decision to approve the renewal and modification or deny the permit action based on the permit application, the compliance status of City of Lincoln Construction & Demolition Waste Disposal Area, and public comment received. NDEQ will publish notice of the final decision and notify the applicant and other interested persons.
COMMENT PERIOD. All comments or requests for a hearing must be postmarked by April 22, 2018.
