NOTICE OF INTENT TO MODIFY PERMIT #NE0204030
for Waste Management of NE, Inc. Pheasant Point Municipal Solid Waste Landfill
under consideration by the
Nebraska Department of Environmental Quality

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environmental Quality (NDEQ) has received an application to modify the permit of Waste Management of NE, Inc. Pheasant Point Municipal Solid Waste Landfill, 13505 N 216th St., Bennington, NE. After review of the permit application, a preliminary determination has been made to recommend modification of the permit.

FACILITY DESCRIPTION. The permit allows the operation of an existing municipal solid waste landfill under Nebraska's solid waste management laws and regulations. The landfill shall receive household waste, alone or in combination with other types of wastes such as commercial solid waste, industrial waste, nonhazardous sludge, or conditionally exempt small quantity generator waste, and which is not a land application unit, surface impoundment, injection well, or waste pit.

MODIFICATION. The major modification is for the installation of a leachate evaporation system. The evaporator will consist of a unit, located next to the existing leachate pond, capable of managing up to 45,000 gallons of leachate per day and will operate with the facilities landfill gas. The leachate volume is estimated to be reduced by 90% with the remainder as residuals to be distributed over the permitted landfill. Prior to the distribution, a TCLP will be done to show the residuals are nonhazardous.

FACILITY LOCATION. The property is located at 13505 N 216th Street, Bennington which is approximately 5 miles west of Bennington on Pawnee Road and ½ mile north on 216th Street. The legal description of Waste Management of NE, Inc. Pheasant Point Municipal Solid Waste Landfill is Section 1 Township 16 North Range 10 East of the 6th Principal Meridian Douglas County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. When a permit is modified, only the conditions subject to modification are reopened. All other aspects of the existing permit shall remain in effect for the duration of the unmodified permit.

The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed modification. The NDEQ will make a final decision to renew or deny the permit based on the permit application, the compliance status of Waste Management of NE, Inc. Pheasant Point Municipal Solid Waste Landfill, and public comment received. NDEQ will publish notice of the final decision and notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by October 27, 2018.
