APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the application for the following animal feeding operation.

This Public Notice period will be from June 7, 2012, through July 9, 2012. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The proposed livestock waste control facility (LWCF) is located in the NW Quarter, Section 34, and Part of the S Half, Section 27, Township 21 North, Range 01 West, Madison County, Nebraska. The application proposes the following major modifications: Renovation of an existing holding pond, construction of one new holding pond, five new debris basins, and one new lift station, all in three phases.

The application indicates an existing maximum of 9,000 head of feeder cattle, and proposes an increase of 5,000 head of feeder cattle, for a total maximum capacity of 14,000 head.

The existing LWCF includes 3 holding ponds, and 8 debris basins, and proposes the construction of 1 new holding pond, 5 debris basins, and 1 lift station.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued permit. Upon completion of review of any written comments received, NDEQ will make a decision on the application and respond to any comments.
