APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the application for the following animal feeding operation.

This Public Notice period will be from March 28, 2012, through April 27, 2012. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The proposed livestock waste control facility (LWCF) is located in the SW Quarter, Section 27, Township 11 North, Range 20 West, Dawson County, Nebraska. The application proposes the following major modifications: Construction of one new barn, with an increase of 1,200 head of nursery swine.

The application indicates an existing maximum of 952 head of farrowing swine, 5,004 head of breeding/gestating swine, and 2,576 head of finisher swine, and proposes an increase of 1,200 head of nursery swine, for a total maximum capacity of 9,732 head.

The existing LWCF includes 1 earthen lagoon and 2 buildings with underfloor shallow pits with pull plugs. Proposed construction includes 1 new building with an underfloor shallow pit with pull plug.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued permit. Upon completion of review of any written comments received, NDEQ will make a decision on the application and respond to any comments.
