NOTICE OF INTENT TO APPROVE
APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the application for the following animal feeding operation.

This Public Notice period will be from June 13, 2012, through July 13, 2012. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2438).

The proposed livestock waste control facility (LWCF) is located in the NW Quarter, of Section 05, Township 08 North, Range 02 East, Saline County, Nebraska. The application as submitted is for an existing maximum of 1,660 head of finisher swine and for a proposed increase of 830 head of finisher swine, for a total maximum capacity of 2,490 head.

The existing LWCF includes one earthen storage pit and two buildings with underfloor shallow pits with pull plugs, and the proposed construction of one building with an underfloor shallow pit with pull plugs, and one concrete storage tank.

The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130–Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the operation. Upon completing a review of any written comments received, NDEQ will make a decision on the application and respond to any comments.
