Notice is hereby given pursuant to Title 115 – Rules of Practice and Procedure, Chapter 5, that the Nebraska Department of Environmental Quality (NDEQ) is conducting a public hearing regarding the tentative decision to renew and modify the permit to G & P Development, Inc., PO Box 63, Milford, NE to operate a municipal solid waste landfill in accordance with Title 132, the Integrated Solid Waste Management Act and Nebraska Environmental Protection Act. The current permit will expire on June 15, 2012. NDEQ has received a request for permit renewal and modification from G & P Development, Inc. to operate a municipal solid waste landfill at the site generally described as the N ½ SE ¼ Section 14 Township 9 North Range 3 East of the 6th Principal Meridian Seward County, Nebraska. The hearing will focus on environmental issues associated with the landfill, and other issues as outlined in State regulations and statutes within the jurisdiction of NDEQ.

A major permit modification is for a proposed lateral expansion of the waste disposal area contiguous to the west boundary of the existing disposal area. The proposed lateral expansion will expand the permitted site boundary to the west by 36.97 acres, (1,610,413 square feet), and add 24.1 acres, (1,049,636 square feet), of contiguous lined waste disposal footprint. The addition of the west expansion property will bring the total G & P Development property acreage to 117. The gross airspace capacity added to the G & P Landfill by the proposed west lateral expansion is approximately 3,730,000 cubic yards. The total gross capacity of the landfill including the proposed lateral expansion is approximately 8,730,000 cubic yards. The footprint and numbering scheme for all currently permitted cells will remain unchanged.

The Nebraska Department of Environmental Quality will conduct a public hearing on May 15, 2012 at the Webermeier Public Library, 617 2nd Street in Milford, NE. The public hearing will start at 7:00 pm and will continue until all testimonials have been heard. The public is invited to formally testify at the hearing on any issue that might be of concern related to the renewal and modification of this landfill permit. After the public hearing the department will prepare a summary of issues raised at the public hearing and the department responses.

After the public hearing, the Director shall make a final decision to issue or deny the permit renewal. The applicant and other interested persons will be notified of the final permit decision.

Copies of the draft permit, original legal notice and administrative record are available at the Webermeier Public Library, 617 2nd Street, Milford, NE, and at the Lincoln office of the NDEQ, 1200 N Street, Suite 400, The Atrium, Lincoln, NE between 8:00 a.m. and 5:00 p.m. weekdays.
