APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the application for the following animal feeding operation.
This Public Notice period will be from May 30, 3012 through June 29, 2012. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The proposed livestock waste control facility (LWCF) is located in the South Half of Section 6 and Part of the West Half of Section 5 all in Township 7 North, Range 14 West, Kearney County, Nebraska. The application proposes the following major modifications: Increase the number of feeder cattle from 35,000 to 48,000 head, increase in feedlot area, increase the number of debris basins from four to eight, increase the number of lift stations from one to six, abandon the four existing holding ponds and construct one synthetic lined holding pond.
The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued permit. Upon completion of review of any written comments received, NDEQ will make a decision on the application and respond to any comments.
