APPLICATION FOR MAJOR MODIFICATION

Pursuant to the Neb. Rev. Stat. 54-2425 (4) as amended, the Nebraska Department of Environmental Quality (Department) is issuing notice to provide an opportunity for any interested person to submit written comments on the application for the following animal feeding operation.
This Public Notice period will be from April 5, 2012, through May 7, 2012. Comments made should pertain to issues for which the Department has authority under the Livestock Waste Management Act (Neb. Rev. Stat. Section 54-2416 through 54-2435).

The proposed livestock waste control facility (LWCF) is located in the Southwest Quarter of Section 21, Township 27 North, Range 02 East, Wayne County, Nebraska. The application proposes the following major modifications: An addition of previously exempted dairy cattle and the construction of additional LWCFs.
The application indicates an existing maximum of 300 head of dairy cows with 100 head of exempted dry cows and 200 head of exempted heifers. The project will include the construction of a vegetated treatment area for the previously exempted cattle. This will bring a total of 400 head of dairy cows and 200 head of heifers to be permitted when the construction is completed. No exempt cattle will remain.
The existing LWCF includes one earthen storage pit, one diversion ditch, and one gutter flush system. The proposal includes a sump and pump, sand separator and basin, dual sediment basin, and a flush pump for the dairy portion of the operation. The vegetative system includes a debris basin, and a pump from the debris basin to the sprinkler system for the vegetative system for the open lot portion of the operation.
The Department has reviewed the application to ensure compliance with the Livestock Waste Management Act and Title 130 – Livestock Waste Control Regulations. Currently, the Department intends to approve the application for a major modification to the previously issued permit. Upon completion of review of any written comments received, NDEQ will make a decision on the application and respond to any comments.
