for City of Sidney Construction & Demolition Waste Disposal Area
under consideration by the
Nebraska Department of Environment & Energy

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to renew the permit for the City of Sidney Construction & Demolition Waste Disposal Area, 2232 Rd 115, Sidney, NE 69162. After review of the permit application, a preliminary determination has been made to recommend renewal of the permit. The term of the permit shall be five (5) years.

FACILITY DESCRIPTION. The permit allows the operation of an existing Construction & Demolition Waste Disposal Facility under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.

FACILITY LOCATION. The property is located approximately one mile East and ½ mile North from Sidney, Nebraska. The legal description of the City of Sidney Construction & Demolition Waste Disposal Area is E ½ Section 29 Township 14 North Range 49 West of the 6th Principal Meridian Cheyenne County, Nebraska.

OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. Public comments and hearing requests shall be made to: Daniel LeMaistre, Waste Permit Section Supervisor, Nebraska Department of Environment & Energy, P.O. Box 98922, Lincoln, NE 68509-8922.
The NDEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of Sidney Area Solid Waste Agency Construction & Demolition Waste Disposal Area, and public comment received. NDEE will notify the applicant and other interested persons.

COMMENT PERIOD. All comments or requests for a hearing must be postmarked by May 13, 2024.

RECORDS AVAILABILITY. Digital copies of the draft permit, legal notice, and the administrative record are available online at http://deq.ne.gov/. Select “Public Records Search” at the bottom of the page, then “Public Records Search” again. A box will appear that needs the following information: for “Start Date” enter 1-5-2024, for “End Date” enter May 13, 2024, for “DEQ Facility Number” enter 62749, for “DEQ Program ID” enter NE0204170, for “DEQ Program” enter IWM. Select “Search” and all the documents for that facility will appear. Use the “Index of Correspondence” to select the documents related to this public notice.
