for OPPD NC2 – Fossil Fuel Combustion Ash Disposal Area

PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Environment & Energy (NDEE) has received an application to renew the permit of OPPD NC2 Fossil Fuel Combustion Ash Disposal Area, 7264 L Road, Nebraska City, Nebraska. After review of the permit application, a preliminary determination has been made to recommend renewal of the permit. The term of the permit shall be five years.
FACILITY DESCRIPTION. The permit allows the operation of an existing fossil fuel combustion ash disposal area under Nebraska's solid waste management laws and regulations. The fossil fuel combustion ash disposal area shall dispose of fossil fuel combustion ash which, by definition, shall mean flyash, bottom ash, slag, and flue gas emission control ash generated from utility plants or other facilities in which coal is the primary fuel source.
FACILITY LOCATION. The property is located at 7264 L Road, Nebraska City, Nebraska. The legal description of OPPD NC#2 Fossil Fuel Combustion Ash Disposal Area is S ½ SE ¼ Section 25 Township 8 North Range 14 East of the 6th Principal Meridian Otoe County, Nebraska.
OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The NDEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of OPPD NC#2 Fossil Fuel Combustion Ash Disposal Area, and public comment received. NDEE will notify the applicant and other interested persons.
COMMENT PERIOD. All comments or requests for a hearing must be postmarked by May 6th, 2024.
