Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to POET Biorefining – Fairmont, LLC (FID 86026) for the addition of a carbon dioxide (CO2) plant adjacent to their existing ethanol producing facility (Standard Industrial Classification code 2869) located at 1214 Road G, Fairmont, Fillmore County, Nebraska. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed modification at this facility will be: 1.10 tpy of Particulate Matter (PM); 0.23 tpy of PM ≤ 10 microns (PM10); and 0.05 tpy PM ≤ 2.5 microns (PM2.5).

Fillmore County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Fillmore County meets the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which establishes operational and monitoring requirements for the high-pressure wet scrubber used in the new CO2 facility, requires flow measurement and VOC testing for the water which will be recirculated from the high-pressure wet scrubber to the fermentation CO2 scrubber, prescribes a flow limit on the CO2 gas stream from the fermentation scrubber to the CO2 plant, and increases the potential to emit (PTE) for particulate matter based on an anticipated increase in truck traffic.

The proposed permit and supporting materials are available Tuesday, July 2nd, 2024 through Friday, August 2nd, 2024 at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
