Emission Guidelines for Large Municipal Waste Combustors that are Constructed on or before September 20, 1994 -  Subpart Cb

Applicability: eCFR Subpart Cb [ecfr.gov]

This subpart applies to:
  1. Each municipal waste combustor (MWC) unit with a combustion capacity greater than 250 tons/day of municipal solid waste (MSW) that commenced construction on or before September 20, 1994.

Not subject to this subpart*:
  1. MWC capable of combusting more than 250 tons/day of MSW that have a federally enforceable permit limiting them to combusting 11 tons/day.
  2. Qualifying small power production facilities that burn homogenous waste to produce electricity (see section 3(17)(C) of the Federal Power Act (16 USC 796(17)(C)).
  3. Qualifying cogeneration facilities that burn homogenous waste to produce electricity or other forms of useful energy (see section 3(18)(B) of the Federal Power Act (16 USB 796 (18)(B)).
  4. Any unit combusting a single-item waste stream of tires.
  5. Any unit required to have a permit under Section 3005 of the Solid Waste Disposal Act
  6. Any materials recovery facility that combusts waste for the primary purpose of recovering metals.
  7. Any cofired combustor (defined in 60.51b of Subpart Eb) that has a combustion capacity of 250 tons/day or more.
  8. Air curtain incinerators (defined in 60.51b of Subpart Eb) that have a combustion capacity of 250 tons/day or more and combust only yard waste. These units must still meet the opacity standard under 60.37b.
  9. Pyrolysis/combustion units that are an integrated part of a plastics/rubber recycling unit.
  10. Cement kilns firing MSW.
*Many units in the above list must notify EPA and/or the state of their exempt status, provide proof of their exemption qualifications, and maintain relevant records. Please see the rule text for full details.
