eCFR Subpart E  [ecfr.gov]
This subpart applies to:
- Incinerators that can charge more than 45 metric tons/day (50 tons/day) and commence construction or modification after Aug 17, 1971.
Not subject to this subpart:
- Any facility subject to NSPS Cb, Eb, AAAA, or BBBB.
- Any facility covered by an EPA approved State section 111(d)/129 plan implementing subpart Cb or BBBB of this part is not covered by this subpart.
- Any facility covered by subpart FFF or JJJ of part 62 of this title (Federal section 111(d)/129 plan implementing subpart Cb or BBBB of this part) is not covered by this subpart.
